These Terms govern access to and use of the official complaints portal operated by the Investor Protection Service.

1. Introduction and acceptance
These Terms of Use ("Terms") constitute a legally binding agreement between you (the "User", "you" or "Complainant") and the Investor Protection Service (the "Service", "we", "us" or "our"), an independent body that receives and handles complaints relating to financial misconduct. By accessing the portal, submitting a complaint, registering an account or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms in their entirety.
If you do not accept these Terms, you must not use the portal. Continued use following any revision of these Terms constitutes acceptance of the revised version. Material changes will be notified through the portal at least 30 calendar days before they take effect.
2. Purpose of the portal
The portal exists to receive, register and co-ordinate complaints submitted by individuals and entities who consider themselves to have suffered financial harm at the hands of investment platforms, brokers, crypto-asset projects, foreign-exchange firms or other financial schemes. The Service may, at its sole discretion, refer registered complaints to regulators, law-enforcement agencies, payment institutions, accredited law firms or analytical partners.
The portal does not provide investment, legal, tax or financial advice. Nothing on the portal should be construed as a recommendation to acquire, dispose of or retain any financial instrument.
3. Eligibility
To submit a complaint or hold an account you must:
- be at least 18 years of age and have full legal capacity in your jurisdiction;
- provide accurate, current and complete information about yourself;
- confirm that the subject matter of your complaint relates to your own legal interest, or that you are duly authorised to act on behalf of the affected party;
- not be subject to any sanctions list maintained by the United Nations, the European Union, the United Kingdom, the United States or any other applicable authority.
4. Account registration and security
An account is created when a complaint is submitted. You are solely responsible for safeguarding the credentials associated with your account and for any activity that occurs under it. You must notify us without undue delay of any actual or suspected unauthorised access. We may suspend or terminate accounts where we reasonably believe that the security of the portal or other users may be compromised.
5. Accuracy of information
You warrant that all information, statements, documents and evidence supplied through the portal are true, complete and not misleading. The knowing submission of false, fabricated or materially incomplete information is grounds for the immediate refusal of the complaint, termination of the account and, where applicable, referral to the competent authorities. The Service reserves the right to verify any information submitted.
6. Acceptable use
You agree not to use the portal to:
- upload content that is unlawful, defamatory, obscene, harassing or that infringes any third party right;
- distribute malware, attempt to gain unauthorised access, probe or scan the infrastructure, or interfere with the integrity of the Service;
- impersonate any person or entity or misrepresent your affiliation with any person or entity;
- submit duplicate or vexatious complaints intended to overwhelm the Service or harass any third party;
- process, mirror or republish any material obtained from the portal except as expressly permitted by these Terms.
7. Complaint handling and timeframes
A unique case reference number is generated automatically upon submission of a complaint and quoted in all subsequent correspondence. Initial review is typically completed within three (3) working days; full assessment timeframes vary according to the complexity of the matter, the responsiveness of third parties and the jurisdictions involved. Estimated timeframes are indicative only and do not constitute a contractual commitment.
The Service may, at its discretion, decline to register or to continue handling a complaint where: it falls outside the remit of the Service; the information provided is materially deficient; the complaint is frivolous or vexatious; or further action would conflict with applicable law.
8. No guarantee of outcome
The Service makes no representation or warranty, express or implied, that any complaint will result in the recovery of funds, the freezing of assets, the imposition of sanctions or any other specific outcome. Outcomes depend on factors beyond the control of the Service, including the conduct of regulators, courts, payment institutions and the respondent firm. The use of the portal is provided free of charge; any optional services provided by accredited partners may be subject to separate engagement terms agreed directly between you and the partner concerned.
9. Third-party partners
The Service co-operates with regulators, law-enforcement bodies, accredited law firms, analytical specialists and other partners. Where the handling of a complaint requires disclosure of information to a partner, only the data strictly necessary for that purpose is shared. The Service is not responsible for the independent acts or omissions of any partner organisation, and any contractual relationship you enter into with a partner is a matter between you and that partner.
10. Intellectual property
All trademarks, service marks, page layouts, source code, written content, graphics and databases comprising the portal are owned by the Service or its licensors and are protected by applicable intellectual property laws. Save for personal, non-commercial consultation of your own case file, no part of the portal may be reproduced, distributed or used to create derivative works without prior written consent.
11. User-generated content
You retain ownership of the documents and statements you submit. You grant the Service a non-exclusive, royalty-free, worldwide licence to host, process, copy and disclose that content strictly for the purposes of registering, assessing and handling your complaint and for compliance with statutory obligations.
12. Disclaimer of warranties
The portal is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, the Service disclaims all warranties of any kind, whether express, implied, statutory or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted availability and non-infringement.
13. Limitation of liability
To the maximum extent permitted by law, the Service, its officers, employees and partners shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues, goodwill or data, arising out of or in connection with the use of, or inability to use, the portal. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.
14. Indemnity
You agree to indemnify and hold harmless the Service and its partners against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the portal or your infringement of any third-party right.
15. Suspension and termination
The Service may suspend or terminate your access at any time, with or without notice, where it reasonably considers that you have breached these Terms, that continued access would jeopardise the integrity of the portal, or that suspension is required by law. You may terminate your account at any time by written request; certain records will be retained where required by law.
16. Privacy and data protection
Personal data are processed in accordance with the Privacy Policy, which forms an integral part of these Terms.
17. Governing law and jurisdiction
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service is established, without regard to its conflict-of-laws principles. The competent courts of that jurisdiction shall have exclusive jurisdiction, save where mandatory consumer protection rules confer jurisdiction on the courts of your place of residence.
18. Severability and entire agreement
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and any document expressly referred to in them, constitute the entire agreement between you and the Service regarding the use of the portal.
